here is the email I just recieved seconds ago
"Dear cliff reeser,

This e-mail confirms that an Amazon.com A-to-z Guarantee claim has been filed for order #110-0291278-2306650 because the details and/or condition of the item(s) were not as described.

Your comments were "Item was listed in good condition and I recieved the item in very poor condition with the label badly worn and the cart damaged. I messaged the seller with my grievances with attached images of the cart I recieved but got no response, waited a few days and left negative feedback. the next day he responds to my negative feedback saying he offered me a refund but i never responded. My inbox remains empty with no messages from him about a refund. ".

If you do not opt to receive an Amazon.com Gift Card, you will see reimbursement to your original method(s) of payment if the A-to-z Guarantee claim is approved.
You can check the status of your claim by visiting Your Account. In the "Orders" section, select the "View Older Orders" link. On the following page, click on the "View Order" button for this transaction. Then click on the "Problem with this order?" button. This will show you the current status of your claim. If a reimbursement has been processed, you'll see an Important Message listed at the top of the order summary page.

The instant Amazon.com Gift Card option will be available to you on the Claim status page until the claim is resolved.

If you do opt for an instant Amazon.com Gift Card you will receive $38.98 less earlier refunded amount in your Amazon.com account.

If your seller directly resolves your problem, please let us know by replying to this e-mail and placing an 'X' in the box below. "

someone want to explain what the A to Z guarantee is and how it works? is it like ebay buyer protection? does this mean its already been resolved?

Yes it's basically their version of eBay's buyer protection. I guess it did kick in automatically due to your negative feedback according to that email? I don't know.

It's basically been resolved if you're happy with the giftcard but they'll probably investigate more if you want a reimbursement. You can go to the claim status page and opt to select the giftcard and be done with it or wait a bit for an actual refund.

thanks for the help guys, this turned out way better than I thought it would. I hope more people who receive items described as good and very good in a condition that is clearly not in those conditions raise hell about it and perhaps one day our US amazon can be as awesome as the JP amazon. Don't just sit back and take it.

Awesome. Good things worked out for you.

And in case no one already didn't know, the Amazon logo states "Everything from A to Z". I always thought it was clever.

What happened to the feedback and the seller? Did the negative feedback response stay up?

appears to be, but I have taken the liberty to expose his shady bushiness practices on Facebook, Shmups.com, and Nintendo age. I think this site should have a thread devoted to exposing ebay and amazon scammers. If anyone else wants to share this on another gaming site be my guest.

I like that idea. We have posted posted stuff about scams in the WTF/LOL thread before but it gets buried.

Amazon is always a bit of a gamble due to lack of photos. I once ordered a copy of Ys Book I & II for Turbo CD and got a cart-only Ys: The Vanished Omens for Master System.

heh funny thing about Amazon is that its a gamble in the other direction in japan. Rancor ordered me a bunch of super famicom carts for me and he just alerted me that Gundam Endless duel that was listed in good condition cart only arrived to him in excellent condition. this has actually happened a number of times on Amazon.jp where used games listed as good come complete and mint and often with bonus swag like soundtracks and strategy guides. It pisses me off to no end when US sellers list cart only games as LIKE NEW, do they even read the guidelines of what LIKE NEW is? I don't care how minty the cart is if it lacks the box and instructions it is not at all LIKE NEW. Sorry got a bit off topic there but I'll for sure go start a thread like Nintendo Ages's Hall of Shame.

What about the game its self? do you still have the cart? Was there anything stating that you need to send it back?

Years ago I bought a phone off ebay that was listed as very good condition (with some poor pictures) and when I got it, it was terrible, screen was scratched to hell and looked like it had been dropped a few times. I filed a claim and was refunded very quickly via paypal, but I still had the phone... I decided to be honest, and shipped it back to the seller on my dime. I still wonder what would have happened if I kept it...
