I don't think making let's play videos and adding ads is immoral. I don't think Nintendo should profit from someone else's work. If their videos infringe their copyright, they should send a C&D letter, not steal them.
Youtube isn't exactly an impartial judge, so this happens.

Basically we are talking about making money out of nothing (you know, usually the realm of banks). Who ends up with it makes little difference to me. Does it create extra value that is always good for the economy? Good. Do I believe anyone who gets that money deserves it? No, but I can't change capitalism.
Basically it was good while it lasted (for the people who made money from these things), but now that it's over they shouldn't complain. Yes I know I'm not making much sense, mainly because my attitude to this is kind of like "yeah whatever", and all I want is for the complaining to stop cause I don't think either party is the "better man". Just that Nintendo has the law on its side.

I just wanted to chime in and say that there's no point getting worked up about this. If it makes you mad, just do what I do: If you find an LP that you want to watch, download the whole thing to your hard drive. That way you can enjoy it at your leisure and you don't have to put up with ads. Problem solved.

Although I'm unsure where I fall on the Lets Play vs Nintendo thing (I don't really feel like Nintendo are in the wrong, but I don't really feel like it was a good idea either) I fundamentally disagree with the comparison above. A video game is a piece of media, not the device used to create it. I actually thought about using a sampling analogy but reconsidered. I believe sampling would be more analogous to ripping sprites, models, music, or disassembled code from a game and reusing them. I'm not sure how videos of video games are viewed legally however.
