I don't think making let's play videos and adding ads is immoral. I think getting mad at nintendo for taking that ad revenue and then waging an online war against them is immoral (in a very looooooose sense).

Basically I'm just against the way they reacted, cause it showed they only cared about making a lazy buck.

I don't think Nintendo should profit from someone else's work. If their videos infringe their copyright, they should send a C&D letter, not steal them.

Youtube isn't exactly an impartial judge, so this happens.

Not that much of it matters. Thankfully, morality (theoretically) does not dictate the law.

Basically we are talking about making money out of nothing (you know, usually the realm of banks). Who ends up with it makes little difference to me. Does it create extra value that is always good for the economy? Good. Do I believe anyone who gets that money deserves it? No, but I can't change capitalism.

Basically it was good while it lasted (for the people who made money from these things), but now that it's over they shouldn't complain. Yes I know I'm not making much sense, mainly because my attitude to this is kind of like "yeah whatever", and all I want is for the complaining to stop cause I don't think either party is the "better man". Just that Nintendo has the law on its side.

But wouldn't that be much much worse for people who just do let's plays for fun and to share with the community?

I just wanted to chime in and say that there's no point getting worked up about this. If it makes you mad, just do what I do: If you find an LP that you want to watch, download the whole thing to your hard drive. That way you can enjoy it at your leisure and you don't have to put up with ads. Problem solved.

Although I'm unsure where I fall on the Lets Play vs Nintendo thing (I don't really feel like Nintendo are in the wrong, but I don't really feel like it was a good idea either) I fundamentally disagree with the comparison above. A video game is a piece of media, not the device used to create it. In your analogy, I'd say that a Nintendo game isn't the guitar, but the songs created with the guitar.

And people do expect licensing fees and suchlike on songs they've written or composed. Using Nintendo's games to create a video to me is more like sampling someone elses song. Sure you're adding your own creative content and adapting it for your audience, but you still need permission or licensing to distribute it, especially if it's for profit.

I actually thought about using a sampling analogy but reconsidered. I believe sampling would be more analogous to ripping sprites, models, music, or disassembled code from a game and reusing them. I'm not sure how videos of video games are viewed legally however.
