Go ask you local Gamestop and they will say that they cant charge you for something they dont technically have.

From what I've seen GameStop's policies tend to make no damn sense at all, so this wouldn't surprise me. Although, all of their game SHOULD be gutted, with the disc up front in a locked drawer. So, they probably just look at the drawer-o'-discs for inventory...

Off topic: I understand why they and other stores do this for security while letting people pick up the boxes and look at them, but this is why I will NEVER buy another game from EB. Half the time they are scratched and I want to buy new games SEALED; why would I want a game when the seal of authenticity is broken (I'm thinking of MS's seals on 360 games).
