It does not matter whether he wants to refund you or not! It is not his choice. Ebay/Paypal will look at the claim and has every right to deduct money directly from his bank account that his Paypal account is likely tied to. He can kick and scream all he wants, but it is not his choice.
You are CLEARLY in the right. Just provide the evidence of the sellers description vs. what you received. This is a pretty clear cut case.
I got an email from him "im sorry i never intended to be a fraud in any way. i must've confused them". He may have made a mistake as a beginner in ebay. I'll try to file the claim tomorrow afternoon to settle the situation. its late now and I have morning classes.

He sent me a message from the seller "ok ill give you your refund just send it back ill refund you completely". Do you guys think that it is right to send back the psp to him first? then he will pay me back, or could this be a scam. He still has no negative feedback. He has no feedback as a seller except for as a buyer.
I told him his psp was working, but I think the main issue with this psp was that the battery was malfunctioning or becoming faulty. It needs the back door slot battery slot from falling out. He doesn't know how to take care of a psp.

i think he's counting to relieve frustration because he's told you what you should do from the beginning and you keep posting a lot of asinine updates as you kinda fiddle about with what you should do.
if this happened to me, i'd pack it right back up, contact paypal, and ship it out the day they gave me my money back.

Make absolutely sure to pack carefully, take pictures of everything including serial number and whatnot, the packed box, and get tracking. Keep the receipt so you have the weight and time sent along with the tracking too so the guy can't say "I never got it" or "the box was empty".

Yeah, i just made a shipping label bar code confirmation. I just contacted him, so when he gets the info on day it comes. I will also take a few photos right before I mail it out. Thank you all, this is the first time this has ever happened to me.
