By all means guys, please don't publicly link the ROM. I don't want to be the cause of any lost sales of this game. If you can help me, please PM me instead. The soundtrack is pretty amazing though. I don't see any reason why that shouldn't be allowed, so everyone should check that out.

Retrozone sells it, but they've sold their current supply and you can't buy it until they restock. Every time they've had it in stock, demand has been much higher than their stock.
Thing is, Retrozone is the sole seller of the game and Sivak is at the mercy of Retrozone when it comes to how many copies of the game are produced for sale.
Ironically, the whole situation has many parallels to the real situation third party developers found themselves in regarding the NES in the late 80's. Since it was Nintendo themselves who produced the games, it was Nintendo, not Konami/Capcom/whoever that decided how many copies they would make based on their own estimates, and many times they would be proven wrong.
It was not uncommon for a Capcom game such as Duck Tales to come out, become extremely popular and sell out quickly, and then be unavailable for several months while Nintendo produced more.
This problem too didn't just relate to third party games. Zelda 2 came out in late 1988, but you'd be hard pressed to find a copy until the second major production run in mid 1989!

I don't understand why they don't just have more people make copies then.

Ever taken any business courses? One of the fundamentals of smart business is to avoid overproduction. Just like Nintendo back in the NES days, Retrozone had to try to predict what the demand would be for Battle Kid. The market of people who would be interested in a new NES game playable on the real hardware is probably only a couple thousand in North America. The fact that I have a working NES that I play often sitting right next to my brand new Xbox 360 puts me in the minority of gamers.
Of course, since they too are the sole producers of their product, they have to wait until production is complete before they can sell the next batch.

Even though you own the game, this is a currently inproduction game. So it is similar to asking if someone could give me a download link for Monster Hunter 3 or Modnations Racer. I do appreciate that you said not to publicly link to it, so I will leave the topic alive, but I am locking it.
