Not at all, I was referring to both the way it places you against similar skilled opponents and the party matchmaking that let your group stay together game to game. Unfortunately i think yes, you wont be able to access XBOX Live at all. However i am not 100% sure, i think that's what i read in xbox-scene. However since you don't care about gold and online multiplayer, and all you want is DLC, demos and that stuff you can greatly minimize the risks of getting banned by doing these things.
1) Only connect to XBOX Live when you want to download stuff and the like. Do not play your backed up games when you are connected to Live regardless if you only playing single player. Completely disconnect the cable and not just sign out.
2) Create proper stealth patched backups. A recently released tool for that purpose is ABGX 360 (last version 1.0.0)
That does not mean 100% protection but you must be really unlucky to get banned by following the above.
Also i just remembered a forum that the members there, upload demos for 360 games so people who are banned from XBOX Live can burn them to discs and play them. So yeah, i am almost sure that if you get caught you will be banned completely.
