Ok, so I waited a month for MS to repair my third broken 360 and when I received the package today, there was a huge hole in the shipping box...

I know this is not Microsoft's fault, but the fault of UPS. The hole looks odd, as if someone was trying to peek inside, but let's assume it was an accident for now. That means my 360 probably got knocked around. I looked inside and it looks intact, but the plastic wrapping around the console it torn. I'm just wondering if I should open it or contact MS. I don't think my warranty covers physical damage, so I'm not sure if I should keep the box sealed if I need to prove it was the fault of UPS.

MS can't do anything for you at this point. Contact UPS and take it in to a local UPS terminal and open it in front of the manager and inspect for damage together. Don't bother with a UPS Store or other UPS affiliated outlet, go right to one of UPS's own terminals.
This is typical UPS damage and you'll still play hell receiving a claim from UPS if it is damaged but do it right and be insistant that they make it right. I've absolutely no idea why businesses continue to do business with UPS. Fed/Ex Ground and the USPS are far better with packages of all kinds and manage to deliver them on time without damage. I rarely get a package delivered by UPS that isn't mangled in some fashion.

Just called MS and they said I should report it to UPS, but if something is wrong with the console, that it is covered. Still, maybe I should keep it sealed and go to UPS first like you said.
I'm just so busy this week and don't have time to deal with this crap.

He opened the box in front of the manager, and he said you could tell someone had opened and sealed it back up. Obviously someone had stolen it along the way, but the manager made him go through the typical claims bullshit. Luckily MS believed him and sent him a new one through another shipping company.

Well I decided to open the package after some careful investigating with a flashlight, and it appears the console is not damaged at all. I played Lost Odyssey (finally!) for about an hour with no problems. For some reason though, I'm having trouble connecting to Live through my LAN port on my laptop using wireless connection. Some kind of IP conflict, I'll have to work that out.
Anyway, good news is I think it might be brand spanking new console. The manufacture date is 2-22-2008, which I would hope wouldn't be a refurb already.
