Because doing it legally, with Nintendo's approval, means it'll have lots of spit and polish and help support the company that makes the DS to begin with.
That would be pretty cool if it ever materialises. I like the idea of companies embracing homebrew, it helps build a community around a machine and I think they would be well advised to follow this path
