I was reading the news at tehskeen.com and came across this article:

Over at gbatemp.net, this thread discusses the update. Apparently some of the flash cards are not firmware upgradeable so they're useless except in a DS Lite.

I wonder how good the "new version" of the internet browser is. Last I heard it wasn't that much better than the DS retail one.

Really? Is it really so ridiculous for a company to protect its software and discourage users from not updating by blocking access to the store. Its not like they are blocking you access to things you've already downloaded anyways. This isn't an anti-piracy rant or anything. I have an M3 for my DSLite which doesn't get much use, I'm just saying this is not in any way ridiculous.

Actually, yes.

It's not Nintendo's machine anymore after YOU buy it, and this loophole in the DS TOS about updating your system's firmware ect... without your knowledge or approval first is testament to that.

So would you expect Nintendo to abandon the consumer in the event there were errors and bugs in their hardware that made the games designed for it unplayable? After all, its not their machine anymore because YOU bought it. I don't own a DSi, I haven't read its terms of service, but I expect a good company to update their product as they see fit, especially as it pertains to preventing piracy of the software they develop.

I believe you've misread my post.

I don't care about necessary updates as they're a nice way to clean up glitches etc... What I do care about is the fact that it does the update in the background without your prior approval or consent.

Secondly you state that the updates should fix errors or bugs, when in reality all the update did was add an option to be able to upload pictures to facebook and slightly update the web browser in addition to blocking flashcards. The DSi wouldn't ever encounter any bugs or other game breaking feature due to it's firmware as it and the original DS firmware run in tandem at all times from their position hardwired to the board. If the DSi firmware should ever crash due to any DSiWare game or feature then the protocol would reset the unit via the original DS/DS Lite firmware and resolve the issue with a hard reset. All games on DS carts also cause the unit to default over to the original DS firmware and leave the DSi software alone unless that particular game is a DSi enhanced title. There are no glitches or updates needed for DSi firmware outside of updating individual DSiWare games or other superfluous features such as facebook pictures outside of the actual firmware encoded into the unit itself.

Oh and while it's always a touchy issue your rights guarantee the ability to make a backup, archival or general use copy of a piece of software to preserve the original copy for your future use. So yes I think I should be able to use a flashcard, but do I actually own one? No, but if I did I wouldn't pirate DS games I didn't own. Will people try and successfully pirate games this way? Yes. Do I care? No. Because regardless of what a small minority of pirates does I shouldn't lose my ability to be able to protect and preserve what I own.
