Getting hit with a paypal claim
Howdy folks. Just wonderin if anyone has had to deal with paypal for a claim? I sold a laptop that worked fine but a week later its crapped out on the new owner. The owner wants all their money back, but I sold the laptop as-is, and I am suspicious why a laptop that worked would suddenly stop. Paypal is reviewing the case. I sold the laptop to pay off my bills and buy insulin, so giving money back is not an option. ANyone deal with this before?

I've had to file one once, but that was from the buyer side. I ordered a Sega Genesis and paid for it that day. When I hadn't heard back two weeks later, I emailed asking about it, but again, never heard back. I tried several more times over the next two weeks(so a month after I'd ordered it), but with no Genesis and no communication, I filed the claim for a refund. Apparently they refused to communicate with PayPal as well, so I won without a hitch and got a full refund. So I guess keep that in mind. If PayPal asks for information, give it to them. Be as open and up front about the issue as you possibly can be.

if you shipped it by a trackable manner within a week of payment, you're usually in good shape. good luck.

I've had this happen. It sucks. Do NOT leave it in PayPals hands. Call them up, see link below, and discuss this with the claims investigator and see what information they need from you. They do not spend much time deciding these things and its usually in the buyers favor.

Do you have records that it was delivered? That's usually their main concern.
Paypal usually will state that claims can't be for the condition of the item -- just that it was delivered.

Make sure they see the documents (web site) that said it is being sold "As is" and hopefully you have the tracking number. Make sure anything you write to communicate with the buyer sounds professional. Avoid any childish name calling or accusations. Try to be quick to answer any questions paypal asks and provide any information they ask for expeditiously.
I have filed 2 claims as a buyer, one I worked out with the seller, which was a significantly not as described, as he had listed the games as having the cases and manuals, but sent only disks. After several communications, he relented and sent the cases. The other was an NES systems that was never sent. The seller gave a fake tracking number and that was resolved quickly in my favor. It still took a while for the money to be recovered however.

I was not given the opportunity to even work it out with the buyer. They lodged the initial complaint, and I responded quite politely. When I was writing a second response, the buyer upped it to paypal claims and out of our hands. Ive copied the dialog below. The whole situation seems ridiculous to me. I packed the box with packing peanuts and a protective polyurethane case, and the option was there to purchase insurance. THe buyer said there was no physical damage, and the computer worked when I sent it off! It worked fine initially but mysteriously a week later the buyer is not satisfied because it is malfunctioning. Im so aggravated by all of this.
Buyer: laptop was recieved and ran fine 1st night then started freezing up monitor display started showing a black grey blue green and red screens one after another. computer will not function after this and needs to be powered down. took to apple store and they said bad video chip in logic board. cost to replace board $330.00 which is way more then purchace price. Seller states in ebay auction that "Just installed and fully updated OSX 10.4.11 today". Which would seem to indicate machine was running well. Computer was not packaged well for a shipment, it was stuffed in a large cardboard mailer with popcorn for a barrier so computer may have been damaged durring shipment due to poor packaging. the extra ram in computer needed to be reseated which would indicate that it might have seen damage during shipment although the box showed no exterior damage. I WOULD LIKE A FULL REFUND OR WOULD BE WILLING TO PAY $100.00 FOR THE COMPUTER AND HAVE IT FIXED. also have not recieved linksays router which was part of the auction.

Laptops are known to overheat if they are placed on a carpet, blanket or legs for extended periods. When I installed the OS, I ran into no such problem with the display.As stated in the product description, the computer was as-is. I stated that twice, both in the product profile and a question response. In both I also stated that the computer had not been used for some time. I am sorry that you were underwhelmed with my shipping; I have shipped laptops via USPS flatrate boxes many times with no problems. You declined the option of insurance for your package for an additional 10 dollars that I had provided; this may have prevented this issue. I sent the Linksys router via USPS flat rate envelope on Thursday, 4/9, at your request. It should be arriving today, 4/13.I am sorry for any inconvenience and hope to work through this with you.

If its as is, tell him you win and he gets no money back. If he still disagrees, send some muscle over to "convince him", he is in fact, in the wrong on the issue.

Nah, he went a bit ballistic on you too early. Since he didn't pay for insurance and it was likely damaged in transit(that is if he didn't do something stupid to it, which he might have), I don't see how it's your fault. And if he's giving you flak about the router not arriving less than a week after it was shipped, something seems definitely wrong on his end.
