In fact, if you read
the actual document, quite a lot of it makes clear that the data is stored locally (and can be cleared), is cleared once you're done playing, requires your permission, or at least is anonymous. IE, they can record you playing online, but just the in-game data, nothing that links to you.
Third. In repeated claims Microsoft has admitted and even boasted about his monitoring being a marketing tool, that they would save our data and store every single possible part of our information so they can profit from it without any transparency whatsoever.
They've spoken about what the technology is capable of doing. Not necessarily what it's actually being used for.
I mean, they dare to say this:

Excuse me, but Microsoft themselves are saying that it's a spying device that will monitor your conversations for datamining purporses. There's no conspirancy here, it's out in the open.

You understand that others can record and use these communications. Communications in live-hosted gameplay sessions may also be broadcast to others. Please note that Xbox does not listen in on Skype calls.
