My understanding is that Metroid is enjoyed more in the West than in Japan. And it's been demonstrated that Nintendo is a Japan-first company.
As for waiting until the full game is out to serve the C&D, that's actually not surprising. Fan projects come and go all the time. If Nintendo goes after every single one on the first whiff that's a shitton of negative press for them; what makes the math worse is that so many of those would be for projects that would die midway through. This project finished, and that's the time to pull the trigger if your stance is no fan games.

One of the reasons Nintendo isn't in my best graces these days, is the negative way they treat two of my favorite franchises; Metroid and F-Zero. We haven't had a proper side scrolling Metroid since 2004. We haven't seen an F-Zero release since 2004 as well.
So here we are a dozen years later, and no new side scrolling Metroid or any F-Zero stuff period. The DS and 3DS were both ripe platforms for each. Side scrolling Metroid would have been beautiful on DS, with the game on one screen and the map on the other. A new F-Zero with the 3D effect of the 3DS would be glorious. But yeah, forget that.
Instead we've seen side scrolling Mario and Kirby games released continuously (but no side scrolling Metroid), and Mario Kart racers released continuously (but no F-Zero), since 2004. Yeah I know it's about sales, but take a chance Nintendo damn!

Wow. I remember this remake being under development years ago. I didn't think it would ever get finished. I'll play this after I get home from work.

This is something I've been pondering as well. I think someone nailed it a bit earlier in the thread when they mentioned when Gunpei passed. It just seems like no one in Nintendo wants to take up his mantle of the Metroid franchise, and also Nintendo really doesn't do anything that isn't immediately successful in Japan. About F-Zero, I'd say it's just because it doesn't seem like they know how to make them anymore, or just have no interest. Mario Kart sells SO well, I don't think they feel they need to bother with another racing franchise that doesn't have that star-power. Additionally, SEGA largely developed F-Zero GX and AX, not Nintendo. Since they did that, SEGA has had a ton of success with Sonic All-Stars Racing, which is a similar game that I imagine they make far more money from. Both of those things combined leads me to believe there's just not a lot of will at Nintendo to try reviving that franchise.
Both are franchises I love to death as well, but I think it's just the reality that Nintendo really has no will to develop either much further.

It sucks that the take-down happened, but we all knew it was coming. US copyright law is far too strict in how you HAVE to defend your IP's or else you lose them, that there was no way that Nintendo was just gonna let this slide. It'd be incredible if they talked to this guy and gave this some sort of official eShop rerelease or something, but I think that's hoping for a bit much

Yes, but the last two F-Zero games were GP Legend and Climax on GBA, both developed by Suzak, not SEGA or Nintendo. So I see no reason why Nintendo couldn't let another third party develop a new F-Zero. Things like this is one of many reasons why Nintendo ain't what it used to be. As someone mentioned similarly before, I won't get into to much details as this topic alone is for a whole other discussion but I'm happy I kept the things I associate strongly with the Nintendo I enjoyed growing up.
In any event, everyone should get this file as soon as humanly possible!

I'd be very interested to see if sales numbers exist publicly for things like GX compared to Double Dash or AX compared to the Mario Kart Arcade, or MK: Super Circuit compared to any of the GBA F-Zeros. I mean, considering they made THREE for GBA, and one that was even exclusive to Japan, I assume it must have at least a little popularity there, right? Unless it was only released in Japan because they weren't confident enough it would sell at all. I didn't like GX much personally. But it's shocking to remember that F-Zero SNES was a launch title. The tech, the music, the graphics, everything is pretty mindblowing about it. Sure I love the battle stages in Mario Kart, but for single player F-Zero was way more fun to me.
For Metroid's 30th, the composer for the original game gave a message:

I'm about 90 minutes in and think I surpassed the furthest I've gotten in vanilla Metroid 2. I'd be curious if someone can really break down all the changes and liberties they took here. I do miss the iconic elevators to new areas, but it's kind of cool how this map is designed. I really dig how the music channels Prime at times. The log book is an awesome addition as well. Just can't praise this enough.
