Xbox live is killing me right now

I just bought Super Street fighter II turbo and as soon as i clicked download a message popped up that said something like "this action is unavailable try again later." So of course I immediately try again only to find that they have charged me my 1200 MS points but I've received no game. So call up tech support, and they put me through a bunch of random tasks which get me no where(this take well over 2 hours) and then inform me that if I want any kind of refund I have to be wait by my phone/xbox for a phone call over the next 3-4 days some time between 5 and 8. So bummed....

if you pay for a digital download via XBOX Live Marketplace, you can download it an unlimited amount of times with out paying for it again as long as you are logged in as the user who did the original purchase of it.

I've done this a few times before. Like after my Elite died I got a regular and attached the HDD from my elite. But all my arcade games wouldn't play despite my being logged in as LoD, so I just dl'd again as LoD and they started working and I wasn't charged.

I know it wont let me download again without charging me again, it like never registered my download but still charged me my points it is very frustrating.
