The D-pad is very low and it's uncomfortable to use for long periods.

The DPad is generally used less than the circle pad. The d-pad is a bit uncomfortable if you use it a lot as it make you bend your thumb in a slightly weird way.
The buttons are definitely priority. It's not only that they're too far down on that design, but also that they're so close the edge. To rest your thumb over either B & A or Y & B (standard mario control set-ups) would require your thumb to be in such a position that the console wasn't resting in the crook between your thumb and index finger. You'd have to be supporting the weight of the DS useing your fingers instead of your palms. That's not only awkward to do, and uncomfortable, it also gives you a more precarious grip on the system making it prone to dropping. The problem would be compounded if you were using the d pad (which is again too close to the edge in that design) AND buttons.
Also, that select button is horribly placed. Anytime you wanted to press down left on the d pad you'd hit it.

Well howabout if you swapped the buttons up to the top, and moved the right analog slider to the bottom? Just swapped the placements. Is that better than an analog nub? You could move the select button back to the right side of the device too. Maybe I'll do a revision to my mock up.

Haha, maybe.
I do agree that it would've been nice if the bottom screen was widescreen too, although I'm glad they didn't add that with this half way revision. The DS had a lot of games where the action went across both screens though, and the 3DS doesn't. I genuinely believe this is more down to the difference in screen sizes than the fact that one is 3D and one isn't.

The reason I think the bottom screen should have 3D is because of the jarring sensation my eyes feel when I look between the two. I mean, when my eyes are used to the 3D of the top screen, but then I look at the 2D bottom screen, doing that over and over starts to hurt my eyes. I think if both screens were 3D this would not be a problem.

Personally I'm not too down that there isn't the playfield smoothly transitioning between top and bottom like they had on a few DS games. I felt like it ended up being mostly gimmicky and was hard to pull off in a satisfying way. Sonic Rush used it as a way to add feeling when you were going vertical, but most of the time you'd be either on the top or bottom screen. Contra 4 it was a gimmick during the stages (every once in a while you could climb up fast with the grapple) and let them do some extra tall boss fights (whatever), and Metroid Prime Pinball demonstrated the hardest thing about it; having the physical space between the screens feel ok. In MPP they spent a lot of time dealing with the fact that there was a space between the screens and making sure there was travel time for the ball between the bottom and top, and it got thrown off with new DS revisions.

Ill buy one if the XL has the Super Famicom button scheme. But what I really want is a 3ds with tv out out of the box. I know it wont happen, but I can dream. And no, paying $600 for a tvout mod from Japan is not the same.
