Well he was hiding from the brother to risk detection. I dont believe he was still hiding when the father came in. That was implied in the news articles but not explicitly stated.
To me, him knowing he was unwelcome would support determining rather or not he was an intruder.

But going against him, would be that if a man came home and caught his wife cheating in the act, he couldn't shoot the guy even though he deems the guy to be an intruder. So I guess the biggest factor is what the girl told the dad...

This was not always the case! There are multiple, older decisions regarding the exact circumstances under which a man can kill his wife and her paramour, and these cases are the basis for today's (now discredited) "temporary insanity" defenses.

This get more to the point. The father's state of mind is at issue. If, for example, the father had seen the girl holding hands with the boy earlier that day, then his belief that the boy was an intruder was likely unreasonable regardless of the girl's statements. On the other hand, if the girls was showing signs of abuse and screaming hysterically that she did not know him, then the circumstances are more likely to justify the father's actions (regardless of whether the boy was actually an intruder).

:P : Just got boned by a waiter at one of my favorite restaurants :evil: . They have B1G1 on burgers every Tuesday starting at 4pm. So we stopped by as we usually do about every other week and walked in around 3:50 a little earlier then we normally do and grabbed a seat. Waiter came up and asked if we were ready to order at which point we asked if the special was in effect yet :P. Guy told us we could go ahead and order and he would set the order time at 4 since it was only a few minutes away. So we get our meal and it's great as always and by the end everyone is stuffed :P. So we get the check which is usually $25-30 and.... it's $50. Guy comes back to take the check and we ask him if the B1G1 deal had been subtracted off course it hadn't so he takes it back to the manager :P. He then returns and says can't do anything because we showed up 10 minutes early if it had just been 2-3 minutes we would have been fine but they can't stretch the rules that much :roll: . So of course we are all a little pissed since we would have waited to place our order if the waiter hadn't said anything earlier :P not wanting to cause a scene I went ahead and paid it but the waiters 6 dollar tip went back in my pocket :P.

He might have gotten a $20 tip from you. Did you not ask to speak to the manager yourself?

No I'm a kind of timid guy and I knew my dad would blow up if given the chance :P. If my dad hadn't been there I probably would have had the manager come and talk to me so I could explain the situation. However with my dad there it would have escalated into a screaming match or worse and I would be to embarrassed to go back :P .

At least I had $50 in gift cards I was trying to get rid of but it would have been nice if they had lasted 2 nights out instead of 1 :P.
