It was said that cussing on Xbox Live at all is causing bans. And that Skype videos are being monitored and Xbox videos with cussing in it are among the things being reported. The reason the focus was on Skype was because it's causing not only Xbox Live accounts to be banned, but also Skype accounts.
In the article, the person that was banned from Upload Studio admitted that he posted a video in the Upload Studio which included a border-line bad word (starts with a 'd', rhymes with 'hick'). As for the Skype error, it also says that they received a ban in another application, and the Xbox Live ban they had prevented them from using apps that required Xbox Live (namely Netflix or Skype).

Your initial responses in the thread basically just modeled the kind of behavior that Retrodude exhibited with high levels of frequency: jumping down people's throats for pointing out that something he claimed was demonstrably untrue and then accusing them of being mean, smart-asses, elitists, etc.
The difference here is that you are willing to recognize when you made a mistake when presented with the evidence/reasons why. He never, ever would do that and just dug his heels in further, disregarding all sane counterarguments.
Chances are they're just using Kinect's dictionary of "no no words" to keep some tally, then that tells the servers that you did X, Y, or Z classification ... that is starkly different from them actively monitoring your conversations.
Personally, I would imagine something like that would be better used to apply an age classification to the video itself as to note restrict users while protecting others.
But, I doubt they're actually pooling everything you've recorded ... at least not like this. User data is much more interesting and useful to them, anyway.
I for one think this is a move in the right direction. Clever insults are far and few between and make writers like Diablo Cody seem to be of genius. No need to curse, just get imaginative.
Didn't people all ready freak out over this BEFORE the xbone came out? From what I remember people were up in arms thinking Microsoft was spying on them...like the NSA.
And I remember saying: Just another reason NOT to get this next gen's consoles.
I mean if Microsoft is spying on us, what's to stop Sony from spying on us too..and then Nintendo...I kinda doubt Nintendo would, they seem too "goodie two shoes" to be doing that.
