I won't do that. Let's say I did and the story made it viral or got on the Consumerist. What would happen would be that Nintendo corporate would look up the details of my case and see the names of all the people that I dealt with. And they would get in trouble.

The individual people I have dealt with are not the problem - it's obviously a systemic issue. Shaming a company publicly only gets random people fired and lip service to the public.
Maybe now Nintendo will acknowledge Metroid has a fanbase?

If there's a problem with the system, then not bringing it up means it won't get fixed. If those underlings were following some shitty protocol properly, then it isn't their fault and maybe they'd see that the protocol is the problem. You should not be out $90. Full stop.

What a frustrating situation. Sorry to hear. If I understand correctly, you got the console yesterday from Target?

Strong advice: Start with Target. Go there looking defeated and kindly explain what has happened. That you tried to go through Nintendo first, that you had to open the box to test it, that you have shopped with Target for years and this is the first time something like this has happened, and that all you want is a replacement. Don't give up, and be sure to bring a pen and paper to jot down the names of who you spoke with, and when.

Go ahead and print out a BBB complaint form and bring it with you to Target. Don't whip it out (the complaint form) until Target will not replace the system. Play nice until they give you the business, then say "unfortunately I'm going to need some information from you as I'll have to file a BBB complaint". Follow up with Nintendo and do the same if unsuccessful with Target.

Be polite as possible, and sell your story to customer service. "Could you imagine if you bought a WiiU for your kid and on Christmas it didn't work?". Try to find some common ground where they can make an exception. Trust me, it is possible.

Best of luck and hope my advice helps. If I can get Target to replace a three year old iron without a receipt, you should be able to get them to replace your WiiU.

BIG Smile: I am finally done with the toughest semester of school I have ever had to deal with! Done with Calculus 2, done with Physics 1, done with Digital Logic, done with Math for EE's, and done with my last Engineering Fundamentals course! Whoooooooo! Also, my 10-hour drive home last night went smoothly, which was quite nice. :)

Frown: Not much, really. :D

:D Took my wife to breakfast this morning.

:) Stopped as a pawn shop on the way to work and found Clock Tower 3 (PS2) and Fatal Frame (PS2) for $5 each.

:( Clock Tower 3 was missing its manual, and the Fatal Frame disc was cracked. I had to pass on them.

:) The thrift store up the road had a nice, minty copy of Medievil (PS1) for $3.
