I can't imagine any respectable office would request Luke exit his vehicle without any suspicion. Luke already admitted he had been drinking the night prior: "not to excess" whatever that means. If the office caught a whiff - bingo. If the officer suspected he was driving under the influence, Luke's rights were pretty shot at that point.

Vehicle stops are a battleground. Officers cannot and should not take any chances with potential offenders. The only thing that puzzles me is why the officer didn't follow through.
