Can you give more details on the damage? Does the box look like it was damaged in such a way that would cause that corner to break off? If not, this guy is lying through his teeth and passing the buck on the responsibility. The *fact* that he responded quickly with all that pertinent information is suspicious enough.
As for what you can do, depends on where you bought it...if it was eBay, buyer protection has you covered. Maybe see if you can have it repaired or give it away if you're feeling charitable, hehe.

Packaging is all damage-free (suspicious, I know), the Neo was shipped from Michigan & I'm in Indiana, so it wasn't a long trip...
The only thing remotely wrong with the packaging was that, like my top picture there the console was oriented 180 degrees. This made it sit with the back corners high rather than flat in the foam.
The listing showed (or appeared to show) the system working & the seller actually bothered to make (accurate) note of the box condition and contents.
The chipping wouldn't be entirely unheard of as Neos can be a little on the brittle side (like SNES) and the plastics are fairly thin. However, it does just seem more and more suspicious with each detail considered.
I'm not sure I'm ready to be quite so generous as to give it away ATM. Especially as I'm most worried that a claim will cause me to lose the non-broken stuff.
