People get all up in arms about this, but think about it for a few minutes. What are the odds that you will ever pursue legal action against the company? For virtually everyone, it would be zero percent. If you did need legal recourse for whatever reason, arbitration could be sufficient, or in most cases, preferable. Arbitration is held by a neutral third party and binds both sides of the action. If you don't trust the company enough to not somehow influence the arbitrator, or something else illegal or untrustworthy, then you probably shouldn't be doing business with them in the first place.

If they were "fucked up" you could still take action and have it decided by arbitration. Saying "the judgment will be decided by an independent third party" is not taking away your rights to having a judgment in your favour.

Also, they still can't do anything criminal. No contract allows that.

They could accidentally have my credit card information stolen... AGAIN. Along with whatever other personal information.

Don't you see? If we give in on this it means that Sony will be able to kidnap us and sew us together with two other people to create a hybrid PSP/centipede.

No need for me here in Canada. In this country, courts have NOT ruled in favour of Sony, EA, etc. There is no need for me to opt out. Still, court systems are seriously fucked up all over. I'm sorry that in this case the US courts went with the wrong side. Greedy fuckers.

Technically, yes. In reality, definitely not always. It's really a police state here at the core, although thankfully there are enough decent humans in uniform that it is not always as bad as the term "police state" implies. The problem is that everything is in place for it to potentially get that bad.
