This is an arbitration clause, which is a pretty run-of-the-mill clause that appears in a lot of contracts.

And just to be clear, Terms of Service are legally binding unless the terms are contrary to public policy. In the US at least, arbitration clauses are routinely upheld in court, under the reasoning that they reduce the burdens placed on the court system by forcing the parties to resolve any disputes in another venue. Generally speaking, arbitration clauses are null and void only when there's evidence of bias or "unconscionability."

Quite frankly, I'm more surprised Sony didn't have an arbitration clause in its ToS from the get-go.

Fuck you once again, Sony. I haven't used PSN for years but there is no way in hell I will use it in the future. You are a horrible fucking company.

So when Sony remove your games that you paid for from your PSN account for no other reason than 'fuck you, that's why'. You're just going to go; "oh well, I never wanted to sue them in the first place"? No it's not so much the changing of the terms and adding an arbitration clause, it's the fact that they CAN do that now with no repercussions should you accept these utterly bullshit terms.

Arbitration cases almost always side in favour of the corporations. Not that it matters one iota to me, I stopped using and supporting Sony products when they fucked me over the first time. Besides, it's impossible for us fellow Europeans to sign away our statutory rights so this ToS doesn't stand up over here. I just thought I'd make you guys aware of it before you stupidly go supporting Sony and their corrupt business practices.

Is the fact that they can "take away" content something new in this ToS? I was under the impression that basically all of the console downloadbable services had long made this a stipulation. I have never downloaded a single game under the pretense that I will "own" it any way, just that it will be available to play on the machine I've downloaded it to unless I delete it. I ASSUME that, as was the case with original Xbox DLC, none of the downloadable content I've purchased this gen will still be officially available after this generation.

What's new is the arbitration/CAS stipulation, which I assumed was already there as well since it is in most ToS. And, as stated, if there is some truly egregious problem (e.g. a repeat of the hacking mess), than no ToS would be ironclad against a CAS.

I haven't had my PS3 or 360 hooked up to the internet for around 1 1/2 to 2 years now. I don't game online and I don't download games at all so whats the point. From what I read, it seems to cause more frustration than anything. Hell, to be honest I haven't even really played my PS3 or 360 for around 3 months now. My SNES and Wii are used a lot but that's really it.

With the direction gaming is going, its makes you wonder if people will just get fed up with all this downloading crap and greedy business tactics and just stop playing. Or maybe people may just get bored of gaming? I mean how many people can you shoot with a floating gun or how many dragons can you slay before it starts to feel stale? Or do you think video games have gotten to big to have a crash similar to what happened in the 80s?

Sony's new TOS, Capcom making save files impossible to delete, Gamestop stealing vouchers from copies of Deus Ex

Is it just me, or are all the big corporate giants getting much less discreet about their douschbaggery these days? Whatever happened to companies at least trying to fool us into thinking that they actually give a crap about us? Now it's just like, "yeah, we're screwing you and we're being upfront about it too"

I can't remember a time in gaming where it was just so blatantly obvious how evil the big gaming corporations are

It's funny cuz it's true... Wait no, it's sad and bad for us. It's times like this that make me somewhat regret purchasing anything on PSN (and that there's still stuff I wanna buy/play on it). :?
Time for a 2nd PS3, one to do whatever and one for online play perhaps.

I think most of it has to do with the rise of the internet. You can't keep anything a secret anymore.

I think you may be a little confused by what that means to remove online features. It just means that they have the right to pull the online play and extra downloadable extras off the net at any time, which is really no different than EA or 2K Sports pulling their older sports titles off XBLA/PSN every year when their latest game comes out. They're merely putting this note on the back of games to protect them from being sued.

Random guy: "Hey I bought this game cause I wanted to play it online!?"
Sony: "Sorry, we have the right to pull the online services at any time. Just like anyone else"
