Just what do Sony think they are doing? This may be legal in the states (your legal system and consumer rights are insanely fucked up) but it's definitely not legal in the UK (and most likely the rest of Europe). Sony could be in for another big class action lawsuit if they decide to keep this TOS. Our statutory rights protect us from bullshit like this, so effectively Sony are forcing us to agree to terms that we can't legally accept otherwise they are going to take away yet ANOTHER advertised feature of the PS3.
Not only that but they have amended the part of the agreement which describes content and licensing. You are paying for a licence to rent rather than a licence to own. They can take away content that you paid for at any time and you can't do a thing about it should you accept the agreement. By accepting the agreement you waive all rights to take them to small claims court. They can completely fuck everybody over and there's not a damn thing anyone can do about it if they accept the agreement.
Sony amend PSN ToS which waives consumer rights.
Sony amend PSN ToS which waives consumer rights.

Pure greed, Sony knows the drones don't care. Just another move to make all games temporary. Sony put this on their games a long time ago. Note in the black about removing online portion of a game at anytime. Online gaming, DRM and DLC all controlled by Sony keep or remove off PSN.

As you've pointed out many times before, TOS aren't legally binding and thus don't necessarily hold up in court - this is true in the US as well (if less so).Niode wrote:They can completely fuck everybody over and there's not a damn thing anyone can do about it if they accept the agreement.
What ever happened with the class action suits over the removal of linux? Any news?

With or without that term, they would drag the case out for years and drown you in legal fees.dsheinem wrote:As you've pointed out many times before, TOS aren't legally binding and thus don't necessarily hold up in court - this is true in the US as well (if less so).Niode wrote:They can completely fuck everybody over and there's not a damn thing anyone can do about it if they accept the agreement.

...which is probably what is happening to the linux suits.

Well a class action suit doesn't usually cost people like you and I money, even if it does take time. The linux suits were class action suits, as were the hacking-aftermath suits. Sony is trying to stop further class action suits with this new TOS statement, but in reality they can't do that (e.g. it wouldn't hold up in court). It might make people THINK they can't join a CAS, and that is deplorable, but anyone who does join one will not suffer any repercussions.wip3outguy7 wrote:With or without that term, they would drag the case out for years and drown you in legal fees.dsheinem wrote:As you've pointed out many times before, TOS aren't legally binding and thus don't necessarily hold up in court - this is true in the US as well (if less so).Niode wrote:They can completely fuck everybody over and there's not a damn thing anyone can do about it if they accept the agreement.

Ugh. I'm confused. If one opts out, can they still go online?

They can use the web browser, but that's it. You have to accept the terms each time you update the firmware, and if you say no, you can't update. You don't update, you can't use PSN.Betamax001 wrote:Ugh. I'm confused. If one opts out, can they still go online?
