Hahaha I knew you'd feel my plight, sevin :P.

I was also informed about a local reporter who works for the Toronto Star here and typically writes articles about things like this. I just emailed her and let her know everything that happened. Hopefully there's enough for her to go on and write an article. Mark won't get away with this!!!

Not in the US. You can refuse to do anything for anyone as long the reason for your refusal is not their membership in a protected class (e.g. race/religion/sex). "I don't like you" is a perfectly valid reason to refuse someones business anywhere in the US.

FYI, this happened in Canada, not USA.

Thanks for that information, I didn't know that. If that post is to be believed than this manager did indeed break the law by refusing my business. I'll take note of this and relay it to the district manager as well.

What a dick. It's a freaking video game. If they don't want people trading in gutted copies for new ones - they shouldn't sell gutted copies as "new".

See, stuff like this is why I hate Gamestops. I do occassionally still go, because there are few options where I live. Once when I went, I picked up a game that I had preordered. The guy got it for me, and as soon as I saw what was in his hands, I was pissed. It was in a generic game case. The game was scratched. I had preordered a special edition, that came with a bunch of extra stuff, and this shit is presented to me. My dad asked, "Is this the wrong thing?" I told him what was wrong, and he went off. Bad.

I happily left the store with my special edition and 4 other new games....
Systems: Game Boy, Game Boy Color, Game Boy Advance, N64, Gamecube, Xbox 360

WTB: Boxes for a silver Gamecube System(and a hyperport cover), and a box for an Ice Blue N64 console. Will pay 7.50 for each and shipping.

Read that post a little harder.
Nothing expressly gives a business the right to refuse service. That's a common law proprietary entitlement

Common law is traditional. What they are saying is that it's so obvious that proprietors have the right to refuse service that it's just implied. You don't need a specific allowance in the law, it's just part of what it means to own property.

It is outrageous how Gamestop sells opened copies as new, and even more outrageous that they wouldn't want someone exchanging an opened copy for a sealed one. Make up your fucking mind, Gamestop.

And yes, OP, you should never buy an opened gutted copy for the same price as a new sealed one. If you don't like the idea of selling opened copies for full price, don't support it.

And really, you shouldn't shop at Gamestop ever, for any reason. They are bad for the game industry in more ways than one. After this whole ordeal is behind you, I hope you decide to stop giving Gamestop your business.

this is true. If enough people refuse to buy "new" games because they are gutted, then eventually corporate will have to listen up and stop gutting them.

this is false.
