Well this is crap, Thankfully this ruling does not affect my state. I understand the reason for Affirmative Action, but never believed its the right method for EQUALITY in admissions to colleges and jobs. QUALIFICATION alone and not Gender or Race should be the requirement for any position. I want the best doctor for heart surgery, engineer to build bridges or fireman saving a life. Not someone less qualified who was selected because of race or gender. Frankly I would be embarrassed if I got into college because of my race, showing I'm not as smart as the one that got passed over.

A federal appeals court has struck down Michigan's 2006 ban on the consideration of race and gender in public-university admissions and government hiring in the latest round of the decade-long fight over the University of Michigan's affirmative action policies.
The 2-1 ruling on Friday by the 6th Circuit U.S. Court of Appeals said the voter-approved ban "unconstitutionally alters Michigan's political structure by impermissibly burdening racial minorities." Michigan's attorney general, Bill Schuette, said he would appeal the ruling.
Michigan's ban on affirmative action - covering both government hiring and admission to public colleges and universities - was made part of the state Constitution after a 2006 voter initiative that passed by 58 to 42 percent. It was known as Proposal 2 and prohibited public institutions from giving "preferential treatment to any individual or group on the basis of race, sex, color, ethnicity or national origin."
The initiative followed two 2003 decisions by the U.S. Supreme Court, which found that while the University of Michigan could not set quotas for certain racial groups, or give them extra points in admissions, it could consider race or ethnicity as one factor in admissions.
Jennifer Gratz, a white student who was wait-listed at Michigan in 1995 and served as the lead plaintiff in one of the Supreme Court cases, then began the referendum campaign to amend the state Constitution to ban affirmative action. Gratz was backed by Ward Connerly, who had successfully campaigned for a similar anti-affirmative-action proposition in California in 1996.
Ironic this happened just before the 4th of July, the celebration of freedom and equality.

I can understand what your saying but these professions are not really what you fall into casually. If you want to be a doctor,engineer,or fireman then it takes some time to get into that career. I can't imagine the amount of time in medical school or classes necessary for an engineer degree. As a fireman, I don't know the qualifications for it. If I was going to enter one of these career fields then I would have to commit to it and if I get picked for race to enter a college that could help me succeed in my career then I'm in it to win it. Just my thoughts on the subject.

Actually a case like this just happened in Alabama concerning Firemen. Some minority candidates didn't do as well as Caucasian candidates on their Firemen exam, so they claimed the test was biased against minorities and started arguing for racial-based scoring systems.
I never understand how biasing things toward minorities solved anything. You can't really right past wrongs or undo some people's current bias against them.

Unbelievable how anyone can think a test is created so one race can score better. Is that even possible when there is no language barrier? Perhaps it was not the test itself, but the hiring screener knew who took the test and fixed the scores. A reason why applications and tests should not include gender or race to keep everything equal.
In a blow to the city of Chicago, the U.S. Supreme Court ruled (Lewis v. Chicago, May 24, 2010), that the firefighter test used to select academy trainees was discriminatory and constituted a disparate impact on black applicants. The potential payout to plaintiffs could cost the city upwards to $100 million.
Ironically, the firefighter test in question and approved by the city was ordered constructed by Mayor Daley in 1995 specifically to avoid a “disparate” impact on minority applicants and to increase diversity in the fire department. Toward this end, Daley hired a black psychometrician, Dr. James Outtz, to construct a new and improved firefighter test.
The city administered the new firefighter test developed by Dr. Outtz to some 26,000 applicants for 600 openings. A score of 89 percent or above was needed for candidates to be considered for hire in the first round. Of all the whites who took the test, almost 13 percent scored at or above the 89 percent cutoff score, while only slightly above two (2.2) percent of the blacks fell into this range. The city established that candidates who scored between 65 and 88 percent would be placed in a possible hire category for future consideration.
The test results showed that 6,000 black applicants scored between 65 and 88 percent. It was this group who sued since none had received job offers, thus the disparate impact. Those below 65 percent were told they had no hope of being hired.
To accomplish this, the test design depended mostly on videos of firefighting techniques followed by test questions. Only a small part of the test depended on reading ability. Dr. Outtz presumed that many blacks had reading difficulties.
An embarrassment to judge a Race like that. Something very wrong here.
