3DS license and DRM nonsense

I'm offering 10 to 1 that if the new Sony handheld has the exact same ToS, a few of the people saying "not that big a deal" will go completely batshit.

That said it's not the ToS that's keeping me from buying one, it's the price tag with no gba support. Thanks but I'll keep my DS Lite and my cart filled with tons of great homebrew.

They won't brick your console if you are caught using unauthorised software in the EU. Why? Because it's illegal. The other reason is, Nintendo aren't that fucking stupid. If they brick your system you will stop buying their games. Simple as that. Who in their right mind would go out and buy another after they [Nintendo] bricked it. To be honest as long as Nintendo don't remove shit from my 3DS under the guise of 'protecting their investment'. Then give me the lose/lose scenario of updating and keeping access to new games/online or keeping features but losing new games/online. I'm not bothered. It's when a company forces me into a corner and gives me an ultimatum that I am totally not happy with. Nobody should be forced to make that decision, nobody should be punished for updating their system. It makes no sense at all.

As I've said many many times before. EULAs are NOT law. If the terms are deemed unreasonable you aren't bound by them. They are essentially a catch all to cover their ass in court if they get sued for dumb shit. The important stuff is still trumped by consumer law, at least in the EU. Fuck knows what your [USA] backassward consumer laws are like. Non-existent, from what I've gathered from this forum...

As it stands corporations and some politicians actually convinced the public that a government agency who's sole job was to protect consumers was a bad idea and just another example of socialism taking over. It might, but what if you if don't set up any internet connections on the 3DS? It shouldn't work then. Plus, there is a physical toggle switch to turn wireless networking on or off.

It's good that there's a toggle switch. With lots of restaurants, coffee shops, and random neighbors sending out wifi it could be hard to keep a 3ds out of range in some places. It'd be like some kinda wifi minefield.

That's actually a common misconception, far and away the biggest donors to political parties are average workers (in the form of unions). Over the past 20 years or so Corporations account for an overall much smaller percentage of the money going into political campaigns.

Even if that were true, I don't live in the USA. We still have a pretty solid grounding of consumer rights here in the EU. EULAs don't trump consumer law, it's as simple as that.

I've said it several times now, but we really need to have someone join the forums who knows something about consumer law. Aren't there any lawyers in the eaves? Maybe a lurker who is a law student or some such? Someone who knows more than googling will tell them about license agreements, ToS, consumer laws, etc. would be a godsend to these inane repeating discussions.
