They have no business taking my photos from my system and looking at my friends list, ect. It has been proven before that just because you put something in the terms of service does not make it legal. I don't think mailing a thousand bricks to Nintendo would make them change their terms of service but a court case would. Unfortunately it would take a court case to really show what they can and cannot do. I could have you sign a paper saying I can kill your first born child. If you signed the paper would it make that legal to do so? No.

Nintendo can say that they own every picture on our 3DS's but that's not true. The 3D photos that are on my 3DS are mine, god dammit.

The moment they try to take someone's pictures and use them without permission, I hope they get sued out the ass. People call me a Nintendo fanboy but I won't support Nintendo if they do something really bad like using other people's photos without permission. Hopefully this is just a line in the TOS and it doesn't mean much since it will never actually happen. We could just be worrying over nothing. I'd like to say I trust Nintendo to do the right thing. I feel like Nintendo generally tries to make quality products and treat their customers well.

I always hated license agreements. I can't think of a time I've bothered to read one and not come away disturbed. The bit about owning the pictures and stuff is nasty. No decent person would even think of selling...er licensing something to another human being under those terms. :shock:

The bricking if you do something unapproved is pretty bad too. There are certainly legitimate reasons to do unapproved things with consoles. I don't care if a company bans me from a service or voids the warranty, that is their right, but preventing me from playing all or some of the consoles games by intentionally bricking it or something else is another matter.

The most sickening part is they probably have half a chance of the courts upholding this junk.

You guys do realize Nintendo was the poster child for "Evil Japanese Mega Corporation" from about 1987 to 1994, right? I highly doubt the decade long back alley beating by Sony has taught them anything.

Well, import games would be the main thing for the 3ds. For other consoles there are unapproved 3rd party controllers, memory cards, and other accessories.

I don't have a 3ds, but I thought it updated itself automatically if it ever came in contact with wifi.

It might, but what if you if don't set up any internet connections on the 3DS? It shouldn't work then. Plus, there is a physical toggle switch to turn wireless networking on or off.

If the 3DS is still capable of automatically updating and bricking itself, even if someone deletes all internet set up configurations and keeps wireless turned off, that would be pure bullshit.

I still keep my PS3 all hooked up to my home network with settings intact, and it has never auto updated itself. If Sony won't do it, then there is no way Nintendo would. For those wondering, I leave my PS3 connected to my network so I can stream media to it.

Well if this doesn't get changed I'm sure as hell not going to get a 3ds for at least 6 years, when they are cheaper
