It will be fun seeing how Sony deals with this. Essentially this means checkmate for their current ban wave. They cannot risk banning innocent users (which this little tool makes possible) and risk a class action lawsuit. Especially not in the EU, they'll get absolutely ass-raped by the courts. It would be extremely foolish for Sony to continue banning consoles based on their current criteria.

Companies can't be held liable by the misuse or abuse of hacked software by a third party.

The individual doing the dirty work is the one who's responsible, Sony's clearly shown their hatred for it and tried to stop it on numerous levels. If anything else, that's what's called an alibi.

Oh and the EULA clearly states that you were ever guaranteed the right to use PSN in the first place, it's actually considered a privilege that can be taken away at any given time for any reason whatsoever.

If sony's wanting to ban people who cheat online, I can't really find much to fault them for that.

I just wish folks would recognize that there is a difference between a guy who wants to use homebrew to play .mkv files and a guy who's cheating online and pirating ps3 games.

You do know that the EULA is in no way a legal contract, and it only exists so corporations can cover their asses from basic claims. You can go to court and win, but most of the time it's not worth the money and/or time to do it.

That's just hilarious. Though technically you're not unbanning your console, you're simply spoofing your console's ID.

Yes precisely, but should you get an ID of somebody else's legit console, Sony will simply ban that as well. It's not the innocent users fault his/her console got banned, and it's not the hackers fault the console got banned. It's Sony's fault.

Actually, it is the hacker's fault. He's the one trying to circumvent the ban.

I don't agree with this nor with Popo's reply. If the ban can be circumvented in this way it is also Sony fault for not having a good enough method that only catches guilty users.

If someone frames an innocent and the innocent gets punished, there is blame in the person that framed AND there is blame in the person that punished.

I think that if Sony is aware that the ban can be circumvented like this they should halt the bans - it is much worse to punish an innocent than to let several guilty* go unpunished (I think that applies in general within the U.S. legal system as well, so...)

Ivo.

* This is in general, I can find counter-examples myself.
