That's for the librarian of congress to decide. Not the judge. The judge doesn't make exemptions to the law, he rules on whether the activities fall under the existing exemptions.

If Sony were actually intelligent... they would just offer him a good paying job. But on the grounds that he no longer exploits the PS3 or any other Sony product in the future.

But of course, Sony is like borderline retarded these days. Which is why they're in last place this gen. Had they not done so many things to piss gamers off then they probably wouldn't be in the situation they're currently in right now.

Geohot is more of a figurehead than anything else. All the important work was done by nameless people behind the scenes.

Also, rumor has it that Sega tried this with Kalisto back in the day. They were promptly replaced by Eschalon.

I'm absolutely failing to see where he circumvented the copy protection. Honestly. It just did not happen. There is NO circumvention occurring here. At all.

If I had to guess, I'd say the notion is that he is distributing keys that he was not allowed to have. I'd assume they're considering it a similar situation to if someone made a copy of your house keys and then distributed those copies to other people. Sure, now they aren't breaking in to your house, but it's still a violation of your home security. Not saying that's how they'd eventually rule, but that seems to be the track they're taking.

Sony does realize that if they win they'll just make a martyr out of him and his hacking methods and CFW will just be posted everywhere, right?

CFW already is posted everywhere...

The thing is, they can't force him to cease and desist if he releases it as a patch. So all you need is the OFW (which you can download direct from Sony) and his patch. Which has absolutely nothing to do with Sony and contains absolutely zero copyrighted code. What they're annoyed about is the release of modified official Sony code, amongst other things that geohot was accused of but didn't actually do. So if you do it via patch, they can't say anything at all, because you're not distributing the binary at all.
