I posted a similar topic about 4 months ago - my 1 and only deal on goozex. I spent 1000 points (equiv of $50 I think it was) on worms for N64. It arrived w/partially torn front label, torn back label and goo on it. I left neg. feedback and requested a refund.

Goozex "team" asked me if it worked (the game) - I said yes, but it's not 1000 points for play value, it is a rarity, if I want the game, I can get it on a better console for $5. ANYONE trading worms 64 for 1000 points knows the buyer is expecting a nice game - I simply want to ship this back, i'll pay. Not allowed to do that, the game works, end of case. Point is, I "lost" my case and "the goozex team" changed feedback I had left from neg to pos. I canceled my account that day, there are people who will absolutely get rid of their shit on there and condition/aesthetics are not taken into account AT ALL, a big goozy goozex joke.

Now that I think of it, shouldn't we all have been done w/it when we saw the company name, I mean seriously, Goozex?

I haven't heard the end yet, but it's looking like there is enough small print in their TOS to make me SOL. Question -- can I recount this situation on my blog without getting in trouble for slander or something like that?

I don't see why not.

Also, maybe file a report with the Better Business Bureau?

If you posted this story on your blog, it wouldn't be slander because slander concerns statements that are not fixed in a medium (eg: oral statements). No one really cares about this distinction though--these days, the line between slander and libel is being effaced, and the two are dealt with under the catch-all umbrella of "defamation."

Legally speaking, you've got two very strong defenses against defamation: (a) truth; (b) opinion.

However, these days certain businesses who are the target of unflattering online reviews will overreach and bring a defamation suit against the reviewers. While there's approximately a snowball's chance in hell of these plaintiffs prevailing in a court of law, they bring these suits simply for the nuisance value--hence the nickname SLAPP (Strategic Lawsuit against Public Participation).

I had a dispute once (it was easily settled though) and I was worried that the dude who claimed the game didn't work would deliberately damage the game before sending it to Goozex.
Since then I have taken pictures before sending a game (with the address on the package to prove trade) but I would hope they send it back to you so you can see why it didn't work for two people.

I do think this should go on the GBPL blog. You have sufficient readership that your warning could assuredly protect someone from dealing with this same fiasco.

Thank golly we have the marketplace here, where a little mutual respect is all that it takes to make 99% of the trades both fair and favorable to both sides.
Maybe now Nintendo will acknowledge Metroid has a fanbase?
