I probably should mention, to clarify.
Activision doesn't have the rights to remake the game.
However, they DO have the rights to make a New Goldeneye game, Except it won't have much in common with the original, other than the name.

Rare asked Activision if it could publish it.
Activision asked Nintendo if it would give it's blessings.
Nintendo said no, even though they were promised GE on virtual console.
Iwata probably thought that MS had more to gain from this deal.
So since Nintendo is back on top, Activision didn't want to do anything that might upset them, since Nintendo could ask for more royalties from Activision.
So Activision said no.
That's what happened. Nintendo didn't have any real pull over this getting released or not. The games seam to belong to Rare, since Banjo Kazzooie and Twooie got released on XBL even though they were originaly published by Nintendo on the N64.
Likewise Rare doesn't have any pull on the DKC games, since the characters belong to Nintendo. Not sure about the code, but it must belong to Rare and it seams they didn't mind getting some extra cash from the GBA and VC ports.

Treyarch are owned by Activision, it is a massive step to say Activision are making something, when it is a another company, even if owned by Activison.
When we talk about the dev of Bad Company 2, we talk about DICE, even though EA published the game and own DICE, it was the team at DICE who developed the game.
Treyarch made QOS, not Activision.

Not quite true. Nintendo was co-developer on Goldeneye. They share rights to the code. Banjo games were developed by Rare alone and Rare owns the copyright. Nintendo just published. Likewise, Rare developed DKC, but Nintendo is the copyright holder of Donkey Kong.
