Pirate cart - should seller pay shipping?

He has to pay for it because he sold something illegal. Those policies do not work for something illegal. :wink:

Replicas of trademarked items. Unauthorized replica, counterfeit, and "knock-off" merchandise is prohibited.

He wasn't buying something illegal though. He got short changed with something illegal instead of the original he thought he was buying.

Wow, I should take note of this; I just bought a copy of Mario Kart DS and it is a pirated copy :(

Just pay the shipping. As you said its no more than $2.00. I think I've sent them for $1.34, but I'm sure postage prices have gone up a bit.

Yes it is unfortunate that it was illegal, but that does not mean you can keep the item. You paid a price for an item and if you get a refund for the item you need to return the merchandise. As other posters said, some sellers may end up giving it to you, but illegal or not I'd want my item back. In the seller's defense (kind of), I'd want the item back 1) as verification it was a bootleg and 2) to know the buyer wasn't going to pocket the refund then try to sell the bootleg off again. I think you're trying to pull a switcheroo on him or anything, but just send the item back at your cost. The fight isn't worth it over $1.50.

Yeah, but thats cause you sell bootlegs. At least you let buyers know.I don't think he should keep it but at least not pay for shipping like the title says. He should throw it in the garbage after tearing it to pieces. Yeah its not worth fighting over $1.50 but if you chicken out on everything just because of the small cost, it will add up.

I just heard from the seller. He's going to credit me for the return shipping.

@molotovwars, yes, I know it's only $1 and change but it's the principle of having to pay some amount of money that I got nothing to show for.

Yeah, for me as a seller it wouldn't be worth it to try to disguise an item as legit when it was really a bootleg. Its rare that I sell a bootleg, but I'd rather be clear about it. I guess if I (or anyone else) were to try to pass it off as real it would be better to just take it to some local game store that doesn't thoroughly check. I haven't done it, but why deal with hassle.

Anyways, glad everything will work out for you.

Expect full refund before shipping back, threaten that pic to Amazon, seller will just cover up at your loss.
On top of that you should be allowed to keep for all the trouble, prevents at least one repeat to another buyer.

The seller just refunded me my original purchase price + return shipping. He ended up doing the right thing. Hopefully he doesn't try to sell the cartridge again.
