Oop should have seen it was number 5, was thinking Dreamcast number 2. In that case flip a coin to open or not.

You definitely shouldn't wait 2 weeks and then say the game never showed and get a refund from paypal. That would be totally wrong and bad and stuff. Don't do that...

You should initiate a Paypal claim, but tell the truth, as Niode said. You might be SoL though if he offered to ship with insurance but you didn't pay for it.

Unless this seller has some kind of nefarious scheme where he purposely sells trashed sealed games, I don't hold him entirely responsible.

It was defiantly damaged in shipping. Not really his fault. Anyways, the disc and paperwork are fine. Swapped cases and all is well :)
