Short version: The game "New Super Mario Brothers Wii" (what a mouth full) was leaked to the internet by a guy calling himself "KongzNutz" two weeks before release. Rumor is the guy obtained pre-release copy of the game and dumped it.
Anyway the game was a very high profile title and it was obvious from the start that Nintendo was trying to discourage people from pirating it after it was discovered that the game had a new type of copy protection included in it. This copy protection was cracked before the game even officially hit the selves.
Nintendo managed to locate the guy and are taking legal action against him. They have already searched his home and I assume taken all his computers to help in building a case against him.
Good for Nintendo I say. It is nice to see them actively going after pirates especially one that made available a game which would have probably sold even more copies if it wasn't so widely pirated before its release.

I'm 100% on Nintendo's side on this one. If fact, I'm pretty much against downloading any game you don't own except for testing purposes* (since you can't really rent games for retro systems these days).

still it's overkill imo. should he do some time in jail? of course. should he be bankrupt and forced to pay back a debt he will never be able to? no specially since he didn't make a profit from the pirating.

Really, this is just another case of Nintendo refusing to be content. They make money hand-over-fist, and then want to single out piracy as one of their burdens. I'm not defending the guy's actions, but Nintendo probably should of gone easier on him or just left him alone altogether.

I wonder how many people actually go through the trouble or have the time to hack their consoles allowing for play of pirate backups. Out of my group of 7 or 8 "hardcore" gaming friends I'm the only one. And I've been on social welfare since June, I have the time... I have to admit that hacking the wii was the most fun I've had with the console. I use it for NES, SNES, Genesis emulation and rarely play any actual wii games.

What are you talking about, Flak Beard (which sounds suspiciously like a pirate name...)? Nintendo needs all of these sales! Some of these guys are struggling to pay off their third mansion and yacht.

*This of course assumes that the people who pirate the game for free would be willing to pay $50 for it, or even $45 for it used. Obviously, all the people who pirate it would have bought it had they been incapable of pirating it.

Are they going to blame me for it selling only 3,000 copies the first week in Japan?

unforchantly like 99% of things in life this comes down to MONEY big companys like Nintendo want to make as mush profit as posible thats all they really care about.As for people with low income they cut corners to get by like downloading games ect.This is the main reason I got into retro gaming because I can have as much fun with a 50p gamecube game as i can with a £40 wii game.

KongzNutz doesn't deserve any sympathy by playing the "I'm just trying to preserve obscure games from being lost to the sands of time." card. The game sold 10-freaking-million copies. I would be just as vindictive if he had pirated Super Mario 3 in 1990-something, right before it came out, back when Nintendo was making a profit on the man hours and money they had invested in it. The game is in prolific circulation and has plenty of legit copies out there.
