This may be true, but he wasn't hit with the bat. He was hit by a baseball propelled by the bat. This means there was a loud report to let him know there was a ball on the way if he was inattentive to the pitch. He should have had time to know the ball was headed his way. Even if the ball had been moving a few miles per hour slower, it still would have hurt him very badly if not still killing him. Granted the article doesn't go into details of the accident, but it sure seems like that to me. Just an accident. Sports are dangerous, that's why there's safety equipment involved.

Even in the case of the coffee lady, putting the cup in her lap was really dumb when driving a car especially, but I can agree that you might not expect it to be quite that hot. If you're on a field playing baseball, you have to be prepared for balls moving at high speed or the occasional (not applying in this case) flying bat. Its not like the bat suddenly accelerated and hurt him.

I think this pretty accurately reflects my thoughts on the aluminum bats issue - but since these measures he proposes aren't being taken, lawsuits that help move towards a ban of the bats might not be a bad alternative.

disgusting. I get so sick to my stomach when I hear about cases like this. The easiest way to make a quick buck is to sue about something. I am drinking a beer as we speak and it is making me feel a bit tipsy so I think I will sue the company that made the beer glass because they should have warned me that drinking beer can be dangerous. Sure, I know that drinking beer can be dangerous and hazardous, but I don't have the bottle with the warning on it anymore because I am using a glass and I forgot about what the warning label said so they should have another one on the glass just to be sure.

Better yet, I am suing RacketBoy because looking at a computer for too long everyday is bad for my eyes. I know that looking at a computer is bad for my eyes, but RacketBoy forces me to suffer because their content is so interesting.

I am going to be set for life... you think when I make my millions suing RacketBoy that you guys will still be willing to sell me some sweet games? Will this family let their other children that they have/will have play any sports ever again?

I'm going to have to disagree with you here. It's the same thing as the gradual cutting of fun kid activities because one kid gets hurt. We can't save everyone, and we shouldn't save everyone. Let nature take it's course and weed out those who lack survival skills. And yes, some are just unlucky. That's the way the world works. Bring back dodgeball and stop awarding people for not having two neurons to rub together.

It's not the same - warnings are not the same as bans.

I think metal bats should be banned, but that's because of their increased danger level and because I don't like their sound/feel.

I don't think that hot coffee or dodge-ball should be banned because they are relatively safe, but I think that both should come with fair warnings.

I seem to recall my parents signing waivers and what not for me to participate in risky activities or sports when I was a kid - that waiver functioned as the warning. Waivers/warnings are sufficient - banning would be overboard.

The problem, of course, is that too many people can't figure out this difference and thus do ban "dangerous" things so they don't have to deal with complaints or suits from those "without two neurons," as you put it. This is ultimately laziness on the part of those who enforce the ban, though.

I agree, this reminds me of why I hated Halloween in Southern NJ so much. Because they made it a Saturday (regardless of the date) from 10 am to like 3 pm. No one went trick or treating anymore, everyone just started drinking and doing drugs at an earlier and earlier age because their childhood was officially over.

Yeah, this is happening all over to cut down on crime but all it really does is incite more crime when it becomes something of an adrenaline rush for idiots to do things during a prohibited amount of time.
