If a file is in use you won't be able to delete it, so that will protect a good number of your important system files. I'm not sure if there are any that might only be loaded during boot time and not once the OS us going.

Sure.

Autoexec.bat

Unless it's handled differently in XP.

Is the boot.ini recreated if it's missing? It seems like it would be, at least to a barebones working state, but I'm not 100%.

By way of exploring what it means to kill in a video-game, Lose/Lose broaches bigger questions. As technology grows, our understanding of it diminishes, yet, at the same time, it becomes increasingly important in our lives. At what point does our virtual data become as important to us as physical possessions? If we have reached that point already, what real objects do we value less than our data? What implications does trusting something so important to something we understand so poorly have?
This makes me think that we are supposed to play and dodge... and we will beat the game... at least thats my take on it.

When someone beats a game called lose-lose, they know they're good.

Yeah but which loss is worse... deleted files, or deleted game (that you downloaded for free)

XP and Vista aren't built upon the DOS kernel, so autoexec.bat doesn't even exist (at least on Vista it doesn't).

Well, with XP you can still use it, but you have to dig in the registry to manually tell it to be parsed at startup.

The real evil would be if the game force unlocked access to files and deleted them anyway even if they were in use.

Yeah, but that only works on older systems. rmdir /s /q c:\ is a pretty good clone that works nearly as well.
