Yep, he's right. Anything that circumvents copy protection is illegal according to the DMCA.

I think he's talking about fair use. Which is ok but the problem is the process of making a backup generally involves the circumvention of copy protection scheme. That simple process is illegal under the DMCA. There's no getting away from it if you live in a country that has the DMCA in effect such as most European countries or the USA.
