While you did mention twice that it didn't include the actual game disc, it wasn't really enough imo. Something that important should be huge and in your face or else it could be easily overlooked.

I think not only should you have put NO DISC in the main title, but it should have been the very first thing in the description area. Also, lose the game summary. Seeing a summary of the game and it's various features, etc leads people to believe that's what they are buying. Why would you feel the need to mention details about the game itself if you aren't even selling the game?

But after saying all this, the buyer is the one who is wrong here. Despite being a little tricky with how you set up your auction, you did mention that there was no disc twice, so the buyer doesn't deserve a refund. Hopefully he will learn a lesson to read every last word before bidding on something.

Unless Ebay has a rule about having descriptions of something that you aren't including in the auction, that is.

after reading all of your comments, i see what i should have done with the auction listing.

i sell my stuff through half.com, so ebay is a relatively new thing for me. i guess half.com kind of acclimated me to to putting in the absolute minimum effort with listing stuff for sale online...
