So you're finding unreleased, copyright code, flashing it to cartridges without the copyright holder's authorisation, and selling it for a profit?

To be fair, he's been doing it for a while. I picked up a copy of Earthbound Zero from him a while ago and was very happy with the quality of its work. You also have to consider that the stuff he flashes are either unreleased prototypes or hacks and you have a big instance of the big companies not giving a fuck.

Nope, I was just responding to the earlier post that seemed to think this was a new business. He's been around for a while and hasn't been contacted by any legal departments yet, so that lends more credence to the notion that the companies don't care about this specific instance.

And likely won't ever be, so Nintendo's not actively pursuing it. That's pretty normal for Nintendo.

Copyright is copyright. Released or not.

It doesn't matter if it's "actively pursued" or not. It doesn't matter if it was released or not. It doesn't matter if the company that made it is still in business or not. Copyright is a very black and white thing.

Don't be fooled into confusing it with either distribution rights nor patents. They are not the same thing, despite what ignorant, internet going folks will tell you.

If people don't care and continue to partake, I can't stop them. But they shouldn't try to justify it as something other than copyright infringement. They should at least have the integrity to admit when it's breaking the law (regardless of "moral stance", or any other hand-waving fluff that won't stop people getting fined out the whazoo should Nintendo change their mind about active pursuit of such things).

We're not confusing all of this, we're merely stating reasons why this guy continues to do this without legal repercussions. Don't put words in our mouths. Frankly I think copyright should be respected, though if he doesn't, there's nothing I can likely do without some kind of legal force behind it to stop him.
