Like everyone else on this thread, downloading a game just for emulation isn't breaking any rules really, as I've read many articles about what Nintendo and other companies have to say about the whole emulation "market" that's been going on for almost 15 years or so. They all basically just said that as long as the individual doesn't have intent to sell, we don't give two shits. Hell, Even if you did try to sell them to someone, it's not like a bunch of federal agents have a satellite that pin points your exact location, it's just if it becomes a big deal and all that other shit I don't feel like explaining.
So yeah, aside from viruses you can get from some of the shadier rom sites, it's fairly harmless.

I'm with all this keep games alive business and all... but... there's been a bit of a sea change now old roms (and slightly updated roms) are being sold as commercial products as dlc with copyright in tact... The whole abandonware scene is not as virtuous as it may once have seemed. Having said that, I don't think anyone is about to get the System Shock franchise out of legal limbo anytime soon, and those games can't be allowed to die - so bring on the piracy!

Hmm, I've never seen these lists, I just remember reading an article stating that Ninty doesn't often get pissed about piracy. Nintendo might not have taken action against the Mother 3 translation folks, but I believe it's because it is a Japan-only game. They did, however, shut down the Brawl texture hack project. Nintendo has also tried (and I think they succeeded in some instances) to shut down some modchip and flash cart manufacturers. So, it seems they're more active on some fronts than on others.
