Even if the Security Levels headers were stripped, the content certainly would indicate the sensitivity. No proof since all the Email locked to a private server were deleted and cannot be used as evidence.

1. Clinton read the EMails, did not have enough concern or did not want anyone to know. Public Officials still have to answer for their acts and represent the people so why is the Email deletion not against the law?

2. Clinton did not bother to read the Emails due to overwhelming load of in box. We have all been there auto deleting Spam without reading. However, this is the U.S Secretary of State inbox, ALL Email should have been carefully scrutinized and none deleted! Certainly not sent on a private server preventing appropriate security clearance personnel to verify. How is that even allowed!?

The deletion of government documents which should include all Email between public office representatives if not against the law damn well should be!

The statement "I did not know the security level" and "I forgot" are absolute pitiful excuses especially for the United States Secretary of State! Elken's statement below applies to anyone taking public office. :!:

My point is, I think that there is a bit of a double-standard regarding "crooked" Hillary. Specifically, I think that many people hold her to this standard where every perceived indiscretion or questionable decision disqualifies her from public office while, on the other hand, giving Donald Trump a complete pass regarding his decisions because unethical behavior is, to a certain extent, expected of him.
It is very unlikely that either Donald Trump or the Florida AG will face public corruption charges, but IMO, at least, this behavior is drastically, drastically shadier than failing to properly secure your e-mail account. Yet, there is so little discussion of this alleged impropriety, and I do not see anyone labeling Donald Trump as "crooked" Donald. Why is that?
Seriously. Someone help me. I don't know the answer to that question.

I have mixed feelings on this which can open a can of worms be it a Government sanctioned University or private business schooling. Anyone who attended believing a school called "Trump University" as an official university really needs more common sense.

1. Students blame the school that they can't find work after graduation.

2. Attending a school with that Trump label does "sell" as guaranteed successful in Real Estate business. :?

Because Clinton has yet to go after him on these things. I presume she will do this soon, because if she waits any longer, the public will cease to really care.

If she were running against Romney or McCain, she'd be losing hard by now.

"Mistakes were made." Yeah, as Sec of State, maybe, but even worse as a candidate for President.

See, this is where I keep getting hung up. What law(s) were broken? The law you cited specifies an "unauthorized location", but if the Secy of State authorizes a location as ok to store things, is that not sufficient authorization? Other than the president, what higher authorization would you need? (I also like how the misogynistic language specifies "his". That alone should get her off the hook! )

And...even if I buy that there was some law broken, why haven't we investigated and/or prosecuted former Secretaries of State for breaking the same law?

I agree with this completely. Fools and their money are easily parted...but the ease of parting them with their money does not excuse the person doing it from being a crook.

Undoubtedly. Likewise, if Trump were running against Obama, the Democratic Party might sweep the electoral college. It behooves both candidates that their opponents are so unlikeable.

How many of them ran for president? That tends to raise the stakes.

Perhaps as a matter of public opinion, but her candidacy should have no bearing on whether state-backed legal action/investigation takes place. (By the same token, Trump's candidacy should have no bearing on the legal actions that do or don't take place around him.)

As a thought experiment, I was trying to think of a way someone could violate the Espionage Act through gross - as opposed to ordinary simple - negligence. (Ordinary or simple negligence are not punishable under the Act, and statutes imposing criminal liability for ordinary or simple negligence are generally unconstitutional.) The only things I could come up with were completely ridiculous scenarios. (The oft-cited example of leaving a briefcase full of confidential documents on a crowded bus demonstrates a law professor's ignorance of the distinction between the two concepts.)

Willfully transmitting confidential federal data through known insecure infrastructure constitutes gross negligence.
