I wouldn't doubt that. I also wouldn't doubt just plain old laziness as the possible culprit. Could also be that the people who sent/received it never bothered to, you know, watch the video beforehand.
I only say that because I've personally been sent files and videos that are incomplete and been given the old "Whoops! I didn't check before I sent it!" as a response.
But just not giving a damn is also a very probable reason

Reminds me of when the producers of "The Guy Game" failed to check that all of the girls who said they were over 18 actually were over 18.
^ Exactly. It's the "surely someone else has checked this" mentality. No need to waste 3-4 minutes of your day watching a video to double-check that it's the right one, when you can just pop it on in there and go "Done!".
Is it really only the Wii edition that has the nudity issue though? It's so incredibly odd and random that it wouldn't show up anywhere else.
And who does the lazy/apathetic label fall on? The rating board, or the developer, or the person sending out the video originally? Most likely all of the above?
As a Wii collector (and also a guy who never dislikes seeing naked torsos) this recalled game has me very intrigued. Maybe not intrigued enough to track down a copy, but it's definitely one of those oddball moments that you don't expect to happen often.
Edit: Also, the Amazon review is hilarious if the teens who were "sensitive to this kind of thing" were boys. I'm sure they were sensitive, but the only part they probably wouldn't be keen on is having parents around when the questionable scenes came on. I can't relate to how teen girls would react, but can only assume they would be less phased by it than the boys?
The other possibility is that the dev is european and a flash of boob didn't shock them, and the publisher didn't know about it when submitting for esrb rating.

I still stand by the idea that someone should have reviewed the game before submission, but they failed to, which I think would fall under 'apathy'.
So picked up a couple of games today: found copies of Oregon Trail and Family Game Night Fun Pack for $5 CAD each, and thought that was pretty awesome.
Oregon Trail I wanted because of nostalgia and being kind of a cool retro remake on Wii.
Family Game Night is less appealing to me - I love board games, but rarely play mass market family stuff - but might go over well with my kids and seemed like a good value buy considering what online pricing tends to be.
Not sure if I'll keep both. At some point I'm going to need a different storage solution figured out for my Wii collection. The shelf I've been using only holds 180, leaving me with 8-10 games that won't fit... If I move my imports elsewhere and get rid of a couple kids games there might be just enough room.

Dead Space Extraction is an amazing proof that, if done well, a rail shooter can have every as deep and compelling a story as any other genre of game. I absolutely LOVE that game.
