Would this get you points on your license?
Would this get you points on your license?
My wife got caught going 41 in a 25 and it also turned out we didn't have the most current insurance papers in the car at the time, so she got two citations.
Would that put points on her license, or would it only be a fine?

Re: Would this get you points on your license?
as far as insurance goes it depends on the jurisdiction. sometimes you can take proof that it was insured at the time to the court and get that part waived. some counties make you pay a fine for that anyway, but i'm sure it's no points on your license.
if the ticket was actually written for 41 in a 25, 16mph over is 4 points in MI (OUCH). if they wrote it for any less, its less points.

Eek
Any way of getting out of the points?
I got written up for 70 in a 55 on that highway part outside of downtown Lansing (before they changed it to 70) -- I didn't know it was 55.
I didn't get any points....
Does that get reported to your insurance?

Re: Would this get you points on your license?
I got nailed doing 84 there when it was still a 55. I'm a lucky SOB, the cop only wrote me for 5 over because he couldn't believe I didn't lie to him. As far as getting out of the points sometimes if you take it to court they'll drop points and still asses the fine. if it got written for the full speed, you've got nothing to lose. if they cut you a break for example and only wrote "speed 35/25" in the "charge 1" area of the ticket then you're better off paying it, because if you go to court they may apply the actual speed resulting in a slightly higher fine.racketboy wrote:Eek

Also, points are usually less/dropped in freeway areas. they stick it to you in town.
if the speeding charge goes on your driving record, sooner or later your insurance company will run your driving record and they'll find out. the state of MI doesn't really actively communicate with insurance companies. if you have phony insurance, the cop won't find out unless you were in an accident. very few other states are like this, most require the insurance to be filed with the state so the police can run it on site.

I don't know the details for Michigan but for Texas I am somewhat of a speeding ticket officianado.... You definitely want to take your proof of insurance to the court clerks office in about 7-10 days (enough time for them to get it in their system. That should get that taken off. The citation for speeding is going to be a good one to be eligible for either defensive driving or differed adjudication (probation from speeding for 3 months, as long as she doesn't get another speeding ticket durring those 3 months its is taken off the record)
p.s. my worst ticket was for doing 90 in a 45. i was drag racing at 17 years old.

well she was in town and got written for the full speed.
sad thing is I kept telling her peope get pulled over there all the time...
I guess we'll see what happens.

Then don't have traffic school there? The ticket should say on the back where it outlines the details of your infraction and where to mail payment too.
I know in most places I've lived you can opt to take the driving course (rent the videotape from Blockbuster or take it online, really easy) and you get the points waved and the fine reduced.
Definitely do the proof of insurance thing at the clerk of court.
Doing a google I found your point rules in MI
http://www.michigan.gov/sos/0,1607,7-12 ... --,00.html
That cops a dick... straight up gave you the bare minimum of the 4 point (highest point violation short of felony moving infraction... which is 6). I mean come on 41 in 25... exactly 16 which is the start of the 4 point citation. Copper must of been having a bad day... where was your wifes feminine wiles that day?
Oh and some more googling it appears Michigan does have elective traffic school to dismiss first offense moving violations. basically like here, you get to take the school once every like 2 years towards a ticket. Seeing as this is a 4 pointer in your state I'd really advise doing it, it's like 30 bucks.

They got to it before me. Go for the elective defensive driving course to get it off your record. Of course, then you have to make sure your record stays clean or you get them put back on (usually it's a 2 year peroid that they monitor you for).

Re: Would this get you points on your license?
what you can do is defer your ticket. go before a judge and usually you need to get no infractions for one year, and the ticket disappears and never makes it to your insurance company. but if you get another ticket, its double everything and it all counts!
