Out of curiosity, is there anyway to check availability of a gamertag or even register one without owning a 360?

You should be able to create a gamertag for a Silver account (which is free), and if you ever decide to go Gold, your gamertag remains the same.
I haven't found a way to directly search gamertags, but if you were looking for a friend or suspected a friend's gamertag, indirectly, you could paste this:
http://live.xbox.com/en-US/profile/prof ... Tag=mozgus
replacing everything after the '=' with the name you're looking for. If it exists, that profile will come up, otherwise --> error.
or you could just let one of us know what name you're looking for and we can check it...if you didn't want to create an account just to do all this (since I believe you have to be logged in to view a gamertag profile).

Yup, it is taken. Just logged in and checked their gamertag. Gold account with 3525 gamerscore.

Not necessarily, it just means they've paid for an account sometime in the last 12 months. The account will just revert to silver status when the gold subscription runs out. That is if they pay for it via voucher. If they pay by the recurring option with a credit card it will remain gold forever.
Also, I don't think Microsoft employ any kind of 'pruning' of old accounts on live. My old xbox live account is still 'taken' despite me not using it for a good 3 years now. Short of contacting the user directly and offering to buy the account, which, tbh I don't think is worth bothering with. You either don't bother with live or just live with Mozgus1294873 or something. (I hate names with random numbers in them, its really not that hard to come up with a name that is truly unique.)

there must be a bad smell off me that travels across the intertubes or something, cos I added about 25 tags from here 2 months ago, and only about 8 have bothered to reply/add

for my shame I actually have a PS3 now too - so if anyone wants to beat the crap out of me in Tekken 5:DR or GT 5:Prologue my tag on PSN is also:
