What? No comments on the administration's defeat at the Ninth Circuit Court of Appeals? I read the opinion yesterday, and it is very well-reasoned. It doesn't touch on the religious discrimination issues, and it is largely focused on Fifth Amendment analysis. It is also the harbinger of defeat throughout the remainder of the case.

It is nice to see the Court clip Trump's wings a bit, but I am certain that there are still ways that he can achieve his horrible goals legally. He just won't be able to do by proceeding in such a ham-fisted manner.

Yes, he is, but I think you underestimate his advisory team. Steve Bannon in particular is both highly intelligent and extremely manipulative. The travel ban always seemed more his MO than Trump's. If he cannot do things this way, then he will change tactics but come back again.

Good point. I was hoping Trump would just fire the whole team for failing on the first attempt. He is showing remarkable restraint for a toddler, using twitter as an outlet must be helping with his tantrums.

You really have no idea how the court system or the appeals process works, do you? If you're interested in learning, you should look it up. There are a lot of great resources online.

Thanks. The 9th district is the larget circuit and time to break up based on current population. The fear for me as a Californian would be less conservative pool of judges from Alaska, Nevada and a couple other sensible states.

I was not clear in that 4 to 4. I was insinuating that even at 4 liberal and 4 conservative will have a majority vote to overturn. My bet is 6-2 to overturn, though the smart move is wait for number 9 judge to take his seat.

You are right on Steve Bannon, I think he is the main advisor with the most influence. To hold that position he has to be really on key. I need to read up on his history some more, many detest him for creating Breitbart. Quick look shows Bannon has been around, as a Lieutenant in the Navy, banking, Biosphere 2 (environmentalist really?) and documentary film career. I need to hunt down that Time magazine article, wonder if still on the newsstands?

So, the 9th circuit asked Trump's administration why the stay should be lifted. You know what the White House had to offer? That they though the president's authority on the matter was "unreviewable". That was pretty much it. No evidence whatsoever that the stay put the US in harm's way. No evidence whatsoever for any of their claims. Merely, in finality, that the White House thought that the courts had no standing to challenge the constitutionality of the executive order.

Note that the 9th circuit wasn't ruling on the merits of the immigration ban, just on whether there was cause to lift the stay until the the executive order itself was ruled on in court. And the administration brought nothing for their own defense save, "you can't tell us what to do, ever."

The 9th circuit has been accused of partisanship, but this decision wasn't about partisanship. It was about the White House being literally unable to offer anything compelling at all in court.

jp1, I fail to see how that post is any better than some of CRT's. Trump is neither the Lord and Savior who will fix everything, nor is he a fascist neo-Nazi.

marurun, the statute in question seems pretty clear. If they didn't want the President exercising this sort of power, they shouldn't have given it to him.

8 U.S. Code § 1182

(f) Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.

I'm not arguing that it's necessarily good policy, but the President has been granted this power, for better or for worse.
