The product was a modded playstation. I inquired about it and he told me it "works great". I made an offer and he requested an additional $5 for shipping and a tracker. I agreed and sent money PayPal. He confirmed he had received it and asked if I cared if it were shipped in an envelope since he had no boxes but he could get one from work if I agreed to a short wait. I told him I'd prefer a sturdy box with some packing materials but since I had already made payment it was really up to him to pack it properly.
4 Days later I sent a PM asking about the status of the package. He said he had been busy with work covering for a sick Assistant Manager but that he would get it sent out the next morning.
The next evening I noticed him on so I sent a PM asking if he had the tracker. He told me he had been called into work early so he didn't get it sent out as he had planned.
2 Days later I asked again about the status of the package since it had been one week since he had received payment.
2 Days later he replied saying he was on the way to the Post Office and apologized for the extended delay. He also admitted to forgetting to opt for the $0.80 tracking that he had requested additional money to cover the cost of.
The package arrived promptly enough in a large bubble wrap envelope instead of a sturdy box. When I hooked it all up it didn't work. No picture. This turned out to be an easy fix that had nothing to do with the seller and everything to do with me not realizing that an RF adapter wouldn't work with a modded PS because they re-route the power line to the modchip. I was out some time but no problem since I had the composite cable that came with my PS3 but wasn't using anyway.
Next problem: a grunting, grinding sound like a tiny weed whacker. The system gets to the PlayStation logo and freezes. It tried with 3 games (all originals not burned CD-Rs). I then tried with an audio-CD. It got to the memory card screen but freezes there not allowing you to select either the memory card or the CD player options. I then tried without anything in the drive and it would go to the menu screen but freeze.
Throughout this ordeal the seller was helpful in attempting to walk me through some "easy" fixes such as pointing out my cable issues and having me check that the lens wasn't dirtied up and that it was in the correct position in its little track. I sent him pictures and he looked them over saying everything looked like it should. Problem was it wasn't working.
His next suggestion was to disassemble another working playstation to substitute the parts into the broken modded PS. I informed him my working PS was otherwise spoken for. He suggested Goodwill. I told him I didn't want to spend any more of my time or money on the product and wanted a refund. He said he would reimburse me the cost of the Goodwill PlayStation. While a nice gesture I am not at all comfortable doing the repairs, no matter how simplistic and minor they may be. I admit I probably had the ability to do it. I could see the small screws that would most likely allow the lens and such to be pulled out but it was way out of my comfort zone. Besides I had payed for a working modded PlayStation and not a project.
I again requested a refund.
He replied that it was advertised as modded and that my common sense should tell me that means "AS-IS" (emphasis his). He told me that he was a respected and well-known member of the community and not some "lowball nobody" when it comes to the boards.
When I stuck by my request for a refund he made the offer to go to Goodwill and purchase a PlayStation and send it out to me and assist with the installation. While that is a very generous offer it is not something I'm interested it. I would rather get a refund and buy a working PlayStation. I'm certainly aware that some enjoy tinkering with their consoles and I have great respect, awe and admiration for them... but I'm not one of them. I enjoy playing the games and if I can get to playing games faster and simpler elsewhere then I'm going to.
He then said he couldn't give a refund because his thread said "all transactions are final" and he had to adhere to that statement. I calmly and rationally explained that that only protects him from buyer's remorse and not from defective or misrepresented products. That legally if something is said to be one thing (ex: working modded PSX) and is in fact another (ex: anything but a working modded PSX) then a return can be initiated by the buyer and a refund must be issued by the seller.
PayPal's dispute tutorials have two separate reasons for initiating a refund:
1. Item not received. (They say wait 7 days after payment before initiating... it was 14 days after payment before I received it)
2. Item is significantly different than described. (working vs not-working)
His last claim against giving a refund was that he flat out didn't have the money. He claimed to have less money in the bank than the amount I had sent him. As a general rule of thumb I would say it makes good sense to keep that money until you, the seller, are completely sure that the transaction is settled. While I sympathize with anyone feeling financial pains the buyer should never be made to suffer because of the economic situation of the seller.
4 hours later (sometime after 1:00 am) the money was refunded. The next day I sent the item back... in a sturdy box with plenty of newspaper packing and delivery confirmation tracking number in a PM. Today at 10:30 the USPS delivered it. I'm free.
While some may say I shouldn't leave negative feedback since he eventually accepted the return and issued a refund. The experience as a whole was something I hope no one else has to go through. The numerous shipping delays; The hoops I was asked to jump through to get it to turn on; The excuses and push-back I received for having the audacity to ask such a "respected and well-known" member of the boards for a refund of a non-working product all culminated in what I would consider the worst purchasing experience I've had in years.
This was my second experience with the BST here (though I've been lurking for over a year). The first went flawlessly. Hopefully this is the only hiccup I'll have to go through. Mutual respect, honesty and dealing fairly with others is what makes these user-run BST forums work. Any mods, or anyone else for that matter, interested in further details send a PM and I can quote you the whole ordeal for your own perusal to verify that the transaction experience was in fact negative.
