no it's different. Anyone can make a football game. Just like anyone can make an FPS. But only an NFL licensee can use NFL characters. Just like only the license-holder of CoD is the only one who can use CoD characters in its games.
I'm not sure that's the best comparison though. Call of Duty is a video game series created by a video game developer. The NFL is an entity that existed before long before video games.
Off the top of my head the NES had NFL games by TOSE, Tradewest, LJN, and Tecmo. It would be nice to see that same sort of competition today as opposed to simply getting Madden rehashes year after year. Not saying that EA makes a bad football game, it would just be a lot more fun to see other developers throw their hat in the ring.

Back to the original question though: first party Nintendo games are awesome, and I am always digging NIS and Aksys shit.
