The largest point of contention, I think, are the differences between M and AO since the official ESRB criteria between the two is vague and not well defined. I think the ESRB should re-write the guidelines for an AO game, dropping all references to violence and language and making it specific to hardcore pornographic content.
Well, as it is almost any pornographic content warrants an AO. The only time it is usually excused is for high profile games (Like GTA 4)
Cut a head off to see part of the spine? MA
Pair of anime boobs? AO.
Rewriting it wouldn't fix it, as those rating it know what does and doesn't warrant a MA or AO rating.
For those wondering why games like Street Fighter and Smash Bros. get a T rating, isn't it obvious? It's because the sole purpose of the game is to beat the shit out of each other.
E = minimal cartoon, fantasy or mild violence
E10+ = more cartoon, fantasy or mild violence
T = violence
M = intense violence
AO = prolonged scenes of intense violence
The violence in those particular games is more than E but less than M. Think about it -- Mortal Kombat receives an M rating -- compare it to Smash Bros or Street Fighter and it's easy to see the difference.

According to their very own page Smash Bros doesn't belong in M at all:
Intense Violence - Graphic and realistic-looking depictions of physical conflict. May involve extreme and/or realistic blood, gore, weapons and depictions of human injury and death
I wouldn't say Smash Bros is "realistic" or "graphic" at all. The violence is perfectly on par with Lego games or even Mario or Sonic.
Also, the demonization of sex and nudity is quite disgusting.

Sorry, I orignally put both "violence" and "intense violence" and mixed them up. I was going to edit them but you were too fast.
Anyways, there's absolutedly nothing in Smash Bros that is worse than your average cartoon violence or fart joke and hence should have the same rating.
Also their deffinitions are jank.

Saying that the whole point of Smash Bros is to beat the crap out of each other still doesn't explain it to me. It wouldn't be that much of a stretch to say that the point of Zelda games it to kill things with a sword. Also, the violence in Smash Bros is a lot more whimsical, while the violence in Wind Waker is quite in earnest. I think that "mild" "cartoon" and "fantasy violence" all describe Smash Bros quite well. Zelda... fantasy, yes. Cartoon or mild, not always so much.

Blame this one on western society.
It's not even Western Society in general. It's the United States especially.
