I wouldn't say that. Deus Ex was ported by Straight Right who have been working on the machine since launch (they did the port of Mass Effect). The port is by all accounts very well done. Splinter Cell is also a very nice port. While Mario and Pikmin don't seem to have load time issues, Lego City was pretty damn awful too and that was built explicitly for the system.
I'm not certain what exactly it is and we can only speculate since many games seem to not have load time issues (including several shoddy ports), however, a lot of titles do.

Eh. It's a single peice of concept art. Many Wii U games have been simply represented on the gamepad with no image of the TV shot. Too early to say if that's how it is. with no display on TV.

but why even release it?! if it isn't how the system will do DS emulation, why open themselves up to the critique? use concept art of the ideal, not some gimped approach...
