There's a difference between a scam and people actually trying to deliver a product but having unexpected issues. Ask anyone who has started a business or tried something new. I'm happy to call them out for all the things they've screwed up: Delivering late, overpromising and underdelivering on certain specs, the controller issue, etc. But a scam suggests they went in with the intent to deceive and/or steal money, which so far has not been proven to be the case whatsoever.

I don't think it's a scam. I think it's a great idea for a product that has a niche audience that won't be able to support said product. I hope I'm wrong though.

Personally, as long as I can use the thing as a new XBMC box, then that's all I need to be happy with it. A cheap, versatile media center that that also happens to play games is the same impetus that got me to buy a modded Xbox.

Yes. The only issue for most people will be removing the heatsync, but odds are you will never have to do that. It is honestly alot smaller than I thought it would be.
